How can I make an application to establish a branch organization?

Each application to establish a branch of a society must be made by the parent organization. In addition, each application must contain the following:-

  1. An application must be made in legal form, Form 5 in four copies at a cost of RM 1.00 for each copy to be verified and signed by the two main bearer of the parent organization.
  2. 2 copies of a letter of authorization to use the address as the owner of the premises or place of business of the employer.
  3. Postage stamp affixed worth RM 10.00 on the first copy only the application form (Form 5).

What is the Registrar of Societies Malaysia?

Registrar of Society Malaysia is one of the departments under the Ministry of Interior , which is the main government body that oversees the registration of an establishment . In other words, the organization is also commonly referred to as non-governmental bodies . For that purpose, the laws in force are the Societies Act 1966 and regulations made ​​thereunder , the 1984 Organisation regulations enforced by the Department . Under the Act , an organization is defined as including any club , company, partnership or association of seven or more persons, whether temporary or permanent, formed or registered under any written law lain. Words are not established or registered under any written law other . What are the functions of the Registrar of Societies Malaysia?

The main functions of The Registry of Societies of Malaysia are to administer and enforce the Societies Act 1966, Societies Regulations 1984 and policies pertaining to societies; control and supervise societies so as not to become incompatible with peace, welfare, security, public order, decorum or morality of Malaysia as well as manage and keep registration records relating to registered societies and their branches.

What causes an organization's registration is canceled?

There are many reasons why an organization's registration is canceled. Among the reasons are as follows:-

  1. Association was dissolved by its members under Section 13 (1) (a).
  2. Organization that is against national security, public order or morality of the country and order made by the Minister under Section 5 as provided under Section 13 (1) (b).
  3. Organizations registered in the fraud or mistake or misrepresentation under Section 13 (1) (c) (i).
  4. Organization is used for purposes that violate the law or for purposes contrary to the peace, welfare, order or probation under Section 13 (1) (c) (ii).
  5. Organizations were found to strive for purposes other than the purposes that it is registered under Section 13 (1) (c) (iii).
  6. Organizations found to be intentionally violate the Societies Act 1966, Regulations 1984 Organisation or body of law or breach of Section 4 (1) of the Sedition Act 1948, under Section 13 (1) (c) (iv).
  7. Organization that no longer exists under Section 13 (1) (c) (v).
  8. Organization that has failed to comply with an order to amend the law body of organization as required by the Registrar in accordance with Section 13A, as specified under Section 13 (1) (c) (vi).
  9. Organizations that fail to comply with the provisions of Section 2A as mentioned under Section 13 (1) (c) (vii).
  10. Establishments that violate the provisions under Section 52 as mentioned under Section 13 (1) (c) (viii).
  11. Organizations who have disputes among members or office bearers and failing to comply with a notice under Section 16 (1) as mentioned under Section 13 (1) (c) (ix).
  12. Organizations that fail to submit annual returns as mentioned under Section 13 (1) (d).

How can I set up an organization?

i)  A meeting should be held to establish the organization attended by no less than 7 people and their names should be recorded in the minutes of the meeting.
ii) Meeting shall approve the establishment of the following resolutions:-
- Agreed on the establishment of the association
- Approved the name of the organization
- Approved place of business (address) that will be registered
- Appoint the members of the Committee to conduct registration sponsor organizations
- Approve the constitution and rules of the society registered
- Noting the establishment of the proceedings (minutes) organizations, including the resolutions mentioned above.

Frequency of General Meeting

The frequency of General Meeting:

  1. Annual General Meeting of the General Meeting held each year.
  2. Biennial General Meeting is at a general meeting once every two years.
  3. Triennial General Meeting is held every three years.
